Chronological Brief of Relevant Facts to
the Court

Commissioner, William O. Shultz, theTenth Judicial District Attorneys Office, the Monroe County
Sheriff's Department, and the Tellico Plains Police Department.)
This is a factual account given this 21st day of May 2006 by
National Missions Coordinator George Raudenbush over
Appalachian Youth Missions.
At approximately 3:00 am on 5/18/06, I awoke to a loud noise but went back to sleep. I
awoke to a second loud noise which sounded like a loud knock at the door. I went to the
front door to see who was there. No one was there so I returned to the sofa where I had
fallen asleep earlier that evening. A third loud knock woke me. This time it seemed to come
from the back door. Getting the cordless telephone, a rechargeable flash light, and looking
at the clock above the TV reading 3:02 am I went out the front door in my shorts, a tee shirt
and slippers with the intention of helping a stranded motorist. I closed the front door behind
me and went around the side of the house to assist whoever was in distress the backyard.
The back porch was dark as no lights were installed in the remodeling of the house. As I
approached the back porch I turned on my rechargeable flash light and shined it towards
the back door but no one was there. As I moved the light back towards me it caught a large
dark shadow next to the refrigerator. As the light exposed the shadow it came at me.

The individual was about my height wearing black and dark camouflage clothing having a
dark ski mask covering his head and face. The confrontation began as I was repeatedly
struck to the head, arms and body. I could not see this individual as he blended in with the
darkness. I struggled and  managed to strike a blow with my flashlight to what I thought was
this individual's head holding the telephone in one hand trying to dial 911. A sudden blow to
my head caused me to go down to the ground where I struggled with this individual until
more repeated blows to my head and face rendered me unconscious.
I regained consciousness only to find I was being smothered with a gloved hand over my
mouth and nose. I franticly struggled getting little breaths of air. My attacker told me
repeatedly to be quiet, to shut up, not to talk. I struggled more but was struck several more
times to the head and face, going in and out of consciousness during this process.

At this point, my attacker stated he was going to break my neck, which he proceeded to do
with both hands. He attempted with both hands to twist my head and neck. During this
attempt my abductors gloved finger entered my mouth and I did bit down on my abductors
finger in self defense. I struggled and my abductors bloodied gloves slipped from his grip
losing his hold on me. This was attempted twice but failed as my blood kept my attacker
from holding a grip on my bloodied face and head.

My attacker seemed tired from the struggle and laid his body over mine. I could smell the
odor of stale cigarettes on his clothing and feel the blade of a knife on my neck and face as
he moved the knife around. I was told to get out of town, stating leave tomorrow!

Placing the knife to the side of my neck my abductor asked me if I knew the location of
where his knife was. I replied no. He stated it was my juggler vein and if I moved again he
would cut me open to bleed to death. At that time I felt another metal object pushed into me.
My abductor asked me if I knew what it was. I stated I did not know. He stated it was a gun
and told me to be very quiet.

My neighbors were sleeping less than 50 feet away. The abductor then made a statement
that he was going to cut off my penis and stuff it in my mouth. The abductor asked me a
question, would I like that? He repeated this question twice during that time. Following this,
my abductor listened and told me to be quiet. He appeared to be listening to see if anyone
was responding to my several shouts for assistance earlier.

I heard my abductor opening a bag and hearing duck tape being unrolled. I was told my
eyes were going to be taped but I struggled not to allow this to happen. My body was very
cold, bloodied and my whole body was shaking from the cold. Later, I learned it was in the
low 40’s that morning. The abductor repeatedly told me to shut up as he listened for some
sound indicating someone approaching.

I was assaulted to the face and head each time I struggled. I maintained struggling as much
as possible until I had no more strength to struggle. During these times my abductor rested
and made statements and asked questions. Questions I was asked repeatedly: Is there
anyone in the house? Where is the money you have stashed? Statements made were: You
are a child molester, I want a confession now.

After this time, the abductor told me he was going to transport me away from there. After
telling me this, the abductor placed a call on a cell phone. I was told to be very quiet. After
the abductor ended the call I realized that my abductors plan was to carry me out of the
AYM Office backyard and transport me somewhere else. The abductor verified my very
thoughts verbally by stating that they would be transporting me to another location.

During this time, I was asked to roll over on my stomach in which I strongly resisted as I
sensed my abductor was going to cut my throat using his knife with me facing down into the
ground so as not to have eye contact with me and it being the perfect position to
accomplish such an act without him getting bloodied.

During this time, a strong peace came over me and my abductor began to have dialog with
me as I was exhausted from struggling and he appeared fatigued. He asked me if I wanted
to say a last prayer, I agreed and began praying for my abductor asking Jesus to forgive
him as I forgave him and I apologized for hitting him in the head with the flash light and said
I hope you understand that I believe you would have done the same thing in those
circumstances, had you been in my position. I did not close the prayer.

Waiting till I finished, my abductor ended the prayer by saying Amen. After this prayer my
abductor began talking about different things, I knew he was giving me false information to
protect his identity. The abductor seemed to be getting impatient at not having anyone
arrive. A second call was placed by the abductor. I heard a women’s voice. It was the voice
of Leonard (Lenny) James Ahearn’s wife. The abductor asked to convey his situation to the
boss and to send someone in, to walk in. The abductor waited, listened and then said,
send someone in now! I was lying on my back traumatized, bleeding and shaking profusely
from the cold, being in just my night clothes.

In about 30 minutes another individual arrived, a black cloth was placed over my face while
my abductor and this individual talked softly about my demise. After a few minutes I was
told by my abductor not to move or take the cloth off. I heard the abductor remove an ice
cooler on top of the refrigerator on the back porch and place it next to my head.

I listened carefully as I believed they were going to shoot me in the head and possibly
remove my head into the ice cooler leaving my body. I could hear them walking away from
me quickly so I removed the cloth and turned my head towards North Babcock Street
where I saw a new white 4 door car waiting positioned going out directly across from where
I lay. My abductor and the other individual got in and left.
I managed to get up and go into the house. It was after 5:00 am and I called 911 stating I
was attacked, bleeding and held against my will. A Tellico Plains police officer arrived on
the scene before 5:30 am. The officer did not have a camera or recorder and did not seem
very interested in asking me questions about my condition. The officer didn't take my
situation seriously.

I told the officer I did not have money to pay for an ambulance. He suggested that I call
someone to drive me to the hospital. I called Mr. Scott Morgan. Mr. Morgan arrived asking
the police officer to record my statement on a recorder by asking if he had a recorder. The
officer stated he did not have a recorder or camera to record the events. I gave a brief
statement. Mr. Morgan then took pictures of my condition.

Mr. Morgan took me to Sweetwater Hospital where two C.A.T Scans were done. I was told
my condition was critical, having a fractured skull in three places, broken nose and external
and internal bleeding. I was informed I was being transferred by helicopter to the University
of Tennessee’s Nuro-Trama Center.
"I was detained and held against my will and repeatedly struck to the head and face for
two hours then told that I was going to be sexually mutilated and killed. Jesus allowed me
the opportunity to pray for my abductor".

"I attribute my life, that I am alive today, to Jesus. My verbal pleas for assistance went
unheard by my neighbors but my thanksgivings to Jesus were heard! I believe and know
beyond a shadow of doubt that Jesus did intervene, saving me from certain and calculated
death that early morning".

true, certain and to the best of my knowledge.
